  • Pandemic Prompts Delay of EEO Data Reporting Until 2021

    One item that can now be checked off the 2020 to-do list of many employers…

    Recognizing “the impact that the current public health emergency is having on workplaces across America and the challenges that both employers and employees alike are now facing,” the Equal Employment Opportunity Commission (EEOC) announced on May 7th that it will delay the collection of 2019 EEO data in 2020 because of the COVID-19 public health emergency.

    Note that the reporting is not being waived, rather it is being delayed until 2021, when both the 2019 and 2020 data will be due.

    U.S. Equal Employment Opportunity Commission (EEOC) announced that it will delay the collection of EEO data in 2020 because of the COVID-19 public health emergency.

    In light of the Coronavirus Disease 2019 (COVID-19) public health emergency, and consistent with delays in Federal reporting requirements across the government and other actions taken to relieve employers of unnecessary burdens during this crisis, the Commission has delayed the opening of the 2019 EEO-1 Component 1 Data Collection to a time when the agency anticipates that filers will have resumed more normal operations.  See May 8, 2020 Federal Register Notice Delay in Opening of 2019 EEO-1 Component 1 and 2020 EEO-3 and 2020 EEO-5 Data Collections due to the Coronavirus Disease 2019 (COVID-19) Public Health Emergency.

    The EEO-1 Component 1 Data Collection is currently waiting authorization from OMB.  The EEOC has decided that any EEO-1 Component 1 Data Collection that occurs will not take place until 2021.  The EEOC expects to begin collecting the 2019 EEO-1 Component 1 along with the 2020 EEO-1 Component 1 in March 2021 and will notify filers of the precise date the surveys will open as soon as it is available.

    The opening of the 2019 and 2020 EEO-1 Component 1 Data Collections, as well as the new deadline date, will be announced by posting a notice on the EEOC home page at www.eeoc.gov and sending a notification letter to eligible EEO-1 filers.  When the collections open, the EEOC will provide online resources to assist filers with their submissions and the EEOC Employer Data Team Helpdesk will be available to respond to filer inquiries and to provide additional filing assistance (including, for example, guidance on processing mergers and acquisitions and other corporate changes).
