in Woodland Hills

Woodland Hills, here we come! Employers Group is branching out across the state faster than you can say “Valley Office.” Yes, that’s correct, officially on August 1, our new Woodland Hills office will be open for business. Our new office location:

“As the 'new' EG evolves, one of our first goals has been establishing more offices around the state for the convenience of our members, and to introduce ourselves to employers who are unfamiliar with our HR management services,” says Employers Group’s President and CEO, Mark Wilbur. “Last month, we opened a new Inland Empire office in Ontario, and you can expect offices to open soon in San Diego, with more to come in 2008.”

California's Best Workplaces

Employers Group Launches the First Statewide
“California’s Best Places to Work” Program

Californians are looking for a great place to work and employers are looking for inspired, well-trained workers. Where in California are those matches occurring? Employers Group, the nation’s oldest and largest employer sponsored organization, is about to find out.

“We launched our California’s Best Places to Work Program on July 1st. After our success last year with our “Best Places to Work” program in San Diego, we received numerous requests from our members and non members – employers throughout the state – to deliver a statewide, comprehensive, statistically valid survey. As California’s leading provider of human resource research and counsel, we’re excited to head this effort,” says Mark Wilbur, President and CEO of Employers Group.

A two-part process
Over the next several weeks, Employers Group's research team will measure 125 different criteria from an expected 800 participating companies. Called a “Workplace Assessment,” the dimensions include:

  • Work-Life Balance
  • Employee Voice & Workplace Culture
  • Community Involvement
  • Employee Turnover
  • Pay Practices
  • Benefits
  • Perks and Incentives
  • Training and Opportunity For Advancement
  • Diversity

When the semi-finalists are determined by the scores from this assessment, a random selection of their employees will receive and Employee Satisfaction Survey to evaluate how employees rate their company – from pay and benefits to trust in management and communication with employees.

Looking for the “Top 40”
Finalists will be determined by the scores from both the Workplace Assessment and the Employee Satisfaction Survey. The Top 40 ranked companies will be identified, with 10 each from four company-size categories: Growing, Small, Medium and Large. The companies will also represent all major metro areas across the state, and will be featured in EG’s media campaign and receive recognition as one of California’s “best places to work.”

“Companies participate because, obviously, they’d like the prestige and wonderful PR that comes from winning,” says Juan Garcia, Employers Group’s Director of Research. “But what they also receive is a report card that measures the strength of their offerings to employees. In certain job categories around our state, the competition for good employees is fierce, so information about where a company’s offerings rank can be very important to their overall success in recruiting and retaining employees.”

The deadline to enter the running is September 1, 2007. Finalists will be notified in October, and the top companies statewide will be announced in December. An event to honor the winners will take place in January 2008.

Meal & Rest Wage/Penalty not included in Regular Rate

Q: I am confused regarding the calculation of overtime pay in California. If I fail to provide an employee a meal or rest period in accordance with California law, what should I do?

A: In its Wage Orders, the California Industrial Welfare Commission states, “If an employer fails to provide an employee a meal period in accordance with the applicable provisions of this order, the employer shall pay the employee one (1) hour of pay at the employee’s regular rate of compensation for each workday that the meal period is not provided.” And, “If an employer fails to provide an employee a rest period in accordance with the applicable provisions of this order, the employer shall pay the employee one (1) hour of pay at the employee’s regular rate of compensation for each workday that the rest period is not provided.

Q: Should the extra hour paid be used in calculating the affected employee’s regular rate?

A: No. The regular rate is determined by dividing the employee’s total remuneration (minus exceptions) in any work week by the total hours actually worked in that work week, and does not include the pay for missed or improperly taken meal or rest periods.

Q: Is the extra hour of pay considered an exception?

A: Yes. Recently, the California Division of Labor Standards Enforcement stated: “[The] ...extra hour for failure to provide [a] meal period, [and the] extra hour for failure to provide break and split shift pay need not be included. In Murphy v. Kenneth Cole (2007) ... the [California Supreme] Court indicated that meal period pay, rest period pay, reporting time pay and split shift premium are all forms of pay similar to overtime premium. Because these payments are in the nature of premiums required by law, they are not included in computing the regular rate of pay on the same basis that overtime premium is not included in regular rate calculations. (See 29 CFR §§ 778.201, 778.202 and 778.224).”
