Relieving Employees’ Financial Stress
They Don’t Have to Handle it Alone!

With frantic holiday spending behind us, for many, the first months of the New Year bring added stresses in the form of higher credit card bills, increased minimum payment amounts and mounting debt. Financial stress on employees has a far reaching impact on both the lives of the individuals and how they function at work. For the individual, this stress can lead to alcohol/drug abuse, marital difficulties and depression, and for the employer, loss of productivity, increased absenteeism or even theft.

An EAP can help
Your employees don’t have to handle their financial stresses alone, financial counseling is one area where an Employee Assistance Program (EAP) can help employees by alleviating their financial worries and getting them on the path to being debt free. An EAP is there for them, 24 hours a day, seven days a week.

Share the information below with your employees as a first step in the right direction.

Credit mania or plastic fantastic?
“Charge it.” For some, just saying this has become more of a problem than a convenience. In fact, though many of us have utilized the convenience and opportunities offered by the buy-now, pay-later cycle, for others, this has become dangerously like an addiction, where plastic money becomes fantasy money. Unhappily, financial fantasies tend to become financial nightmares at month’s end.

The Credit Quiz

  • Do you limit yourself to no more than three credit cards?

  • Do you pay more than the minimum credit card payment each month?

  • Do you know, somewhat precisely, how much of your monthly income is required to meet your monthly home, food, transportation and health bills?

A negative answer to any of these questions may warn you of a need to awaken from financial fantasies. If your credit cards’ revolving credit seems to take you round and round and never stop; if your credit cards seem to drive your purchases, leading you to buy simply by providing the opportunity; then it is time to seek help. You can learn to deal realistically with your finances.

Relieving financial stress
You, like many other gainfully employed individuals, may have gotten in over your head using credit cards. But you needn’t drown in despair. A few simple steps will help you to stay afloat. Confidential assistance programs are available to direct you along these steps to competent budgeting, money management and responsible use of credit.

Credit counseling services are national non-profit organizations providing free or low cost credit counseling. These professionals are also skilled in budgeting and can help set up a debt repayment plan for you.

Many employers provide support, information, and outside referrals through employee assistance programs (EAP).

Legal rights
If you’re ready to re-establish yourself as a responsible user of credit, you should know that you have rights and resources available to you for your protection:

  • Credit harassment is illegal. Bill collectors are not permitted to call late at night nor are they permitted to discuss your financial situation with your employer.
  • Your credit history is available to you through a local credit reporting agency.
  • Bankruptcy is a legal option for those facing serious financial difficulties. Chapter 7 erases most debts except child support and taxes. Chapter 13 is a dept repayment plan. Filing for either of these forms of bankruptcy is a serious undertaking. All available options should first be considered in consultation with a qualified professional.

Proposition F
San Francisco’s NEW Sick Leave Ordinance

Q: Who is impacted by the new San Francisco sick leave ordinance, Proposition F?

A: After February 5, 2007, any employer who exercises control over wages, hours, or working conditions – directly or indirectly (e.g., through the services of a staffing agency) – of any individual within the geographic boundaries of the City and County of San Francisco, including part-time, temporary, and Welfare-to-Work employees, must provide their employees paid sick leave. The Office of Labor Standards Enforcement in San Francisco has taken the position that employees with home offices outside the City must also be credited hours toward paid leave for the actual time they spent working within the geographic borders of the City and County.

Q: What does Proposition F require employers to do?

A: Employers of 10 or more employees must permit those employees to accrue at least one hour of sick leave for every 30 hours worked and bank unused sick leave up to a maximum of no less than 72 hours. Employers of less than 10 employees must let employees accrue sick leave at the same rate (one hour for every 30 worked) but small employers may cap the accrual at 40 hours instead of 72. The requirements address minimum accruals only; employers with more generous policies are permitted to continue administering their existing leave practices provided they meet all the conditions of Proposition F. Employers must permit unused sick leave to be carried over from year to year until the employee reaches the accrual cap. New hires must be allowed to begin accruing sick leave no later than 90 days after they begin their employment.

Q: How does this interface with California Labor Code § 233 (i.e., “kincare”)?

A: In contrast to San Francisco’s ordinance, state law currently has no mandate that employers extend any paid sick leave benefits to their employees; however, if employers do offer paid sick leave, employees must be allowed to use half a year’s accrual to care for the illness of a parent, child, spouse, or domestic partner (including any legal ward or guardian).

Under Proposition F, employers must allow employees to use all available sick leave to care not just for the individuals listed above, but also for any sibling, grandparent, or grandchild. The individuals may be connected via biological, step-, adoption, and foster care relationships. Unwed and unpartnered employees may designate one individual in lieu of a spouse or partner to whom they will dedicate such leave time. The point at which they may do so is after the individual works the first 30 hours under the paid sick leave policy and for the next 10 days. If the employee misses this window, they must be afforded an opportunity to make such a designation annually (also with a 10-day window).
