Why Train Employees? Why use State-Funded Training?

The answer to the first question is simple.
More and more, surveys of both employees and HR professionals are revealing that good companies create cultures that recognize and reward their employees. In turn, these employees are more loyal, more committed and more productive. The surveys indicate that training is one of the ways employees recognize that their employers care about them, are willing to invest in and grow them, and that they are valued.

The second question is a little more complex.
You could start by asking one of the 180 companies that have already used the Employers Group state-funded training program, but we wouldn’t want to overwhelm them with the inquiries.

The following information will give you an idea:

  • State funded training was a radical new idea in 1982 when California created the program, which ultimately led to many other states trying to replicate it as a way to attract and retain business. Today, much of the original program is intact except that many of the past laborious requirements are forever gone.
  • Employers Group’s program allows optimal access to state dollars to re-train your employees. Employers Group is a one-stop shop of sorts with the state, which is unusual. This is much better for you.
  • Determining eligibility, handling paperwork, delivering training, dealing with the state and securing the funding are just a few things we do for EG members.
  • Whether you want the state to pay for 100% of the training delivery by fulfilling minimum class size requirements, or you want it to subsidize just a portion because you cannot train that many employees, Employers Group can help you. If you want to train anywhere from 5 – 12 employees, state-funded training can shave 50 - 70% off an on-site program.
  • You can receive such valuable training as the Employers Group’s new basic and advanced leadership modules or you can create your own individual 24, 32, 40 or 48-hour training program utilizing the 4-hour modules in any of our programs.

In May, 2006, Sanrio saw an opportunity to bring key management together and provide them a management training/teambuilding program. Here is what Sanrio's HR Manager Linda Piazza has to say:

How can your company qualify?

  • Companies typically need to be for-profit, which means they pay the Employment Training Tax (which is part of the U.I. Tax).

  • Must typically have a turnover rate of full-time employees of less than 20% for calendar year 2005.

Safe Harbors

Q: What is a safe harbor?

A: The literal meaning of a “safe harbor” is a harbor in which ships are protected from weather or attack by the natural shape and features of the harbor or by manmade barriers. It has come to be used for a set of rules that protect an employer from litigation when all the conditions and procedures are implemented and followed in a good faith effort to comply. Safe harbors are created by being written into laws and regulations. Court decisions may also create safe harbors. Court decisions are, however, more easily changed by other decisions or new laws and regulations.

Q: What are some examples of safe harbors?

A: Most of the better known safe harbors in employment law are in federal law. Here are a few examples.

  • Social Security No-Match – A latest “safe harbor” appears in the rules proposed by United States Immigration and Customs Enforcement on June 14, 2006, which set forth a new procedure for employers in responding to a no-match letter from the Social Security Administration. The safe-harbor procedure includes attempting to resolve the no-match and, if it cannot be resolved within 60 days, re-verifying the employee’s identity and employment authorization through a modified I-9 process. Following this procedure will protect the employer from being accused of having constructive knowledge that the employee was an illegal alien if it is later learned that the employee is indeed an illegal alien.
  • Improper salary deductions - In the federal regulations that define what a salary is, there is a “safe harbor” for employers when they make improper deductions from a salary. The safe harbor requires that they: 1) have a clearly written policy prohibiting improper deductions and a complaint mechanism for employees who believe an improper deduction has been made; 2) reimburse an employee for any improper deduction; and, 3) make a good faith effort to comply in future. In other words, if these three conditions are met, no action can be taken against an employer making an improper deduction from salary.
  • Sexual harassment - The Supreme Court has given employers a “safe harbor,” in a sense, in sexual harassment cases brought under Title VII of the Civil Rights Act. The safe harbor consists of providing effective training and establishing preventive measures and creating complaint procedures. They must be proactive and responsive in the process.

Many of the safe harbors affecting employers are contained in complicated regulations of benefit plans. There are safe harbors in the Consolidated Omnibus Budget Reconciliation Act (COBRA), the Health Insurance Portability and Accountability Act (HIPAA), the Americans with Disabilities Act (ADA) and section 401(k) of the Internal Revenue Code.

Can your organization benefit from an EAP?

  • Are personal or interpersonal employee issues negatively impacting productivity and/or morale?
