2007 California Payroll Taxes
& Outlook for UI Trust Fund

California shows an improved outlook regarding the condition of the Unemployment Insurance (UI) Trust Fund. According to the California Employment Development Department (EDD), the UI Fund balance was $1.3 billion at the end of 2005 and is projected to end with an estimate of $2.4 billion at the end of 2006, $3.0 billion at the end of 2007 and $3.3 billion at the end of 2008. Even though the outlook is getting better, tax rated employers’ will continue to have UI taxes based on the schedule F “plus” a 15 percent surcharge as required when the UI Trust Fund balance dips below specified levels.

This program has been revised for 2007 and includes new topics with fewer hours. The entire series consists of EIGHT 4-hour courses delivered every other week for 16 weeks. Topics include: Introduction to HR, employment law, terminations, wage and hour, leaves of absence, selection and interviewing, compensation and benefits trends and HR communications. BONUS: Participants in this series are able to register for any other course for just $150 each throughout 2007! (Some course restrictions may apply.)

Leadership Skills
This series has been revised to include two components. Choose one or choose them both! This series is geared to all levels of the organization from frontline to supervisory and management. Courses are delivered once a week for six or 12 weeks depending on the skill sets selected.

The first component, the supervisory skill set, encompasses SIX modules including leadership, communications, conflict, motivation, performance evaluation and supervisory laws.

The second component, the productivity skill set, encompasses SIX modules including coaching, teamwork, problem solving, decision making, planning/project management and time management.

Payment of Bonuses

Q: Can the payment of a bonus be conditioned on employment status on the day of payout?

A: Yes, it is permissible to condition receipt of a bonus on having employment status with the company on a certain date, as well as on production. However, depending on the wording of the plan, the bonus could be viewed as legally payable even after termination. The bonus plan should be very clear as to when the bonus is seen as earned and payable, and that can include being an employee at time of payout. Of course, an employer may not discharge or constructively discharge an employee so that he or she is not be employed on that date. Plan language that addresses forfeiture provisions should be avoided as California generally does not allow forfeiture of employees’ wages. The key is to address the conditions under which the bonus is viewed as earned and payable: these are the plan’s “conditions precedent.” In addition, always have the plan in writing, and have it written by a labor attorney.

Q: Explain the differences between discretionary and nondiscretionary bonuses.

A: Discretionary bonuses are in the nature of gifts and are not paid pursuant to a prior promise. Discretionary bonuses are usually not tied to hours worked or production. Because they are not wages, they do not have to be included in “regular rate” (the hourly rate on which overtime musty be based). Nondiscretionary bonuses are those paid pursuant to a bonus contract and are based on production levels, the performance of hazardous duties or the like. These are viewed as wages and must be included when calculating the “regular rate.”

Q: How do I determine deductions from the bonus?

A: Employers should be careful not to deduct cash shortages or merchandise breakages that occur in the normal course of business from the amount of the bonus. Further, if a yearly bonus is paid quarterly, it must not be deducted from the last paycheck if termination occurs before the employee’s first-year anniversary. Employers should be sure to carefully scrutinize any deductions from an awarded bonus.

Most of all, remember to put the plan in writing. Employers Group does provide legal assistance in writing these plans.

By now you are well aware of the raise in minimum wage starting next year. As a result of Governor Sc signing AB 1835, the California minimum wage increases to $7.50 per hour on January 1, 2007, and will rise again on 1/1/08 to $8.00.

And for our members in San Francisco, your regional minimum wage was also raised. Effective January 1, 2007, the minimum wage within your city limits goes up to $9.14 (separate poster).
